Information on the Complaint for Patent Infringement	

Plaintiff : Johnstech International Corp. ("JTI")				
Defendant : JF Microtechnology Sdn Bhd ("Defendant")

Reference is made to JF TECH’s announcements on 12 August 2016, 21 April 2015, 7 August 2014 and 27 June 2014 in relation to a Complaint for Patent Infringement filed by JTI in the United States District Court for the Northern District of California (“the Court”) against the Defendant for the infringement of United States Patent No. 7,059,866 entitled "Integrated Circuit Test Contact to Test Apparatus" ("866 Patent").

The Board wishes to inform that the trial of the above suit was heard from 19 September 2016 until 27 September 2016. On the 27 September 2016, the jury returned a verdict that all 4 claims of the JTI ‘866 Patent were  infringed by Zigma product. The jury also found for JTI on the issues of inducement of infringement and willfulness. The jury further found that the ‘866 Patent is not invalid for anticipation or obviousness. The jury awarded damages of US $636,807 against the Defendant.

We were informed by our attorneys in the United States that the jury’s verdicts regarding willfulness and obviousness are advisory only, as these are issues the Court will decide.

The presiding judge, Judge Donato, indicated that he will not enter a final judgement in the case until after all post-trial motions are resolved and ordered JTI and the Defendant (“the parties”) to meet and confer on a proposed schedule for such motions. The proposed schedule is to be filed by 4 October 2016.  It is anticipated that it may be early 2017 when the post-trial motions are decided and final judgement is entered.  The damages award will not be required to be paid until final judgement is entered, at the soonest.

Judge Donato further ordered the parties to participate in another mandatory mediation before the hearing on the post-trial motions.  He indicated that the parties may mediate with one of the Court’s magistrate judges at no cost or may alternatively mediate with a private mediator.

The Board will consult the attorneys in the United States on our next course of action and will continue to act to protect the interests of the Company.

The Board will make further announcement if there is any material update on the aforesaid case.
