We refer to our announcements dated 9 May 2011, 21 November 2011 and 20 April 2012 in relation to the above matters. Metroplex Holdings Sdn Bhd has served an unsealed Notice of Motion for leave to appeal to the Federal Court on the solicitors for Sunway REIT Management Sdn Bhd on 18 May 2012. Sunway REIT Management Sdn Bhd (the manager for SUNREIT) was informed today that Metroplex Holdings Sdn Bhd has also served an unsealed Notice of Motion for leave to appeal to the Federal Court on the solicitors for OSK Trustees Berhad and SUNREIT on 18 May 2012. Metroplex Holdings Sdn Bhd is seeking leave to appeal against the decision of the Court of Appeal given on 20 April 2012, which dismissed Metroplex Holdings Sdn Bhd’s appeal with costs. No hearing date has been fixed yet. In the originating summons, Metroplex Holdings Sdn Bhd had amongst others, sought to set aside the sale of Putra Place, claiming that the auction held on 30 March 2011 was not a valid public auction and that OSK Trustees Berhad (as trustee for SUNREIT) was not entitled to bid at the public auction.
