We refer to our announcements dated 14 September 2012, 19 September 2012, 12 October 2012, 12 December 2012, 23 January 2013, 6 February 2013, 21 February 2013, 1 March 2013, 6 March 2013, 5 April 2013 and 23 April 2013 in relation to the Nyawai Case. We wish to inform that the Company’s solicitors have been served with a copy of the Amended Writ of Summons and the Amended Statement of Claim dated 25 June 2013 (“the Amended Writ”). In the Amended Writ, the Plaintiffs pleaded that pursuant to an order described as The Native Communal (Agriculture) Reserve (No.13) Order, 2011 ("the Order") made by the Permanent Secretary of the Ministry of Planning and Resource Management vide Gazette No. 14 dated 7 April 2011 in Vol. LVXI of Part II of the Sarawak Government Gazette, part of the Plaintiffs' NCR land (which the Plaintiffs are claiming located within the Provisional Lease of State Land ("PL") described as Lot 410) has been declared as Native Communal Reserve for the exclusive use of the Iban community of Entebu/Selambong/Muton, Saratok, Betong and of which the Plaintiffs are part of that community. The Plaintiffs further pleaded that by virtue of the Order, it is an admission that the Plaintiffs have acquired and/or inherited NCR and/or native title and/or usufructuary rights over the said NCR land which they are claiming located within the PL. The Company’s solicitors shall file in and serve the Amended Statement of Defence in due course. This announcement is dated 4 July 2013. | |
