As previously announced on 14 July 2015, Protasco Berhad’s subsidiary, Protasco Trading Sdn Bhd (“PTSB”) has filed a legal suit at the Shah Alam High Court against PT Goldchild Integritas Abadi (“PT Goldchild”), an Indonesian company and Ooi Kock Aun for inter-alia a declaration that the Coal Supply Agreement dated 4 February 2013 is void and in breach of the Companies Act, 1965 and for a refund of the Deposit paid. 

Ooi Kock Aun’s application to strike out PTSB’s legal suit and PT Goldchild’s application to stay this legal proceedings pending arbitration which was fixed for hearing on 14 July 2015 is vacated pending the disposal of PTSB’s application for an extension of time to file, serve and to use further affidavits. PTSB’s application is fixed for hearing on 3 September 2015. On 3 September 2015, the court allowed PTSB’s application for an extension of time to file, serve and to use further affidavits.

PT Goldchild had on 5 August 2015 filed an application to cross-examine a deponent for PTSB which is fixed for hearing on 21 September 2015. A case management date for Ooi Kock Aun and PT Goldchild’s applications is also fixed on 21 September 2015.

Trial dates of this legal suit which fixed on 28 September 2015 and 29 September 2015 is maintained. A final case management date is fixed on 7 September 2015.
