Sunway-PECC2 Consortium, an unincorporated consortium comprising Sunway Construction Sdn Bhd (“SCSB”) and Power Engineering Consulting Joint Stock Company 2 (collectively referred to as the “Contractor”) had on 28 December 2022 entered into an Interim Engineering, Procurement and Construction Agreement  with Toyo Ink Group Berhad (“Toyo”) and Song Hau 2 Power Company Ltd (“Song Hau 2”), which served as a framework for negotiations and discussions to establish the detailed terms and conditions for the contractor’s performance of carrying out and completing all works of design, engineering, procurement, manufacture, supply, construction, erection, testing and commissioning of a coal-fired electric generation plant with a capacity of 2,100 MW (1,060 MW X 2) for Song Hau Power 2 Thermal Power Plant project located at Song Hau Power Generation Centre,  Hau Giang Province, Vietnam (“Works”).

Song Hau 2 and the Contractor had on 1 March 2023, entered into a formal contract agreement (“Contract”) for the engineering, procurement, commissioning and construction of the Works to set out in detail their respective obligations, responsibilities, rights and liabilities in relation to the performance of the Works.

The Contractor had also on 1 March 2023, entered into a Consortium Agreement to formalize their agreement and to set out the terms and conditions governing the performance of the Works as well as their respective rights, duties, liabilities and obligations under the Contract.

Work has not commenced pending financial close from Toyo and Song Hau 2.

Contract in respect of General Contractor Services for Project JHB1X0 with Yellowwood Properties Sdn Bhd (“Yellowwood”) to carry out the works for a data centre located in Sedenak Tech Park (STeP) in Johor, Malaysia for a contract amount of approximately RM1.7 billion.

The works under the Notice to Proceed (“NTP”) 1 has commenced on 31 December 2022.

In the event Yellowwood requires SCSB to carry out the works for NTP 2 and NTP 3, Yellowwood shall issue NTP 2 to SCSB to commence the works for NTP 2 on or before 1 March 2023 and for NTP 3 on or before 5 May 2023.

SCSB has received the extension of time for the completion of NTP 1 until 31 May 2023. NTP 2 and NTP 3 is expected to be obtained on or before 31 May 2023 in line with the completion of NTP 1.

Letter of Acceptance issued by Malaysia Rapid Transit System Sdn Bhd in respect of the proposed construction and completion of Package 1B Advance Works for Station and Viaducts and Package 5 Terrestrial Viaducts and Ancillary Structures for Project Rapid Transit System Link between Johor Bahru and Singapore (“RTS Link Project”).

Work on RTS Link Project has commenced since 14 April 2023.

Letter of Award dated 18 August 2020 (“Letter of Award”) and Supplemental Agreement dated 15 December 2021 ("1st Supplemental Agreement") (Letter of Award and 1st Supplemental Agreement are collectively referred to as “Principal Agreement”) issued by Sunway South Quay Sdn Bhd ("SSQ"), an indirect subsidiary of Sunway Berhad, which in turn is a major shareholder of SunCon, to SCSB for the Construction of Commercial Mixed Development with Carparks and Amenities at Parcel CP2, Jalan Lagoon Selatan, Sunway South Quay, Bandar Sunway, Selangor Darul Ehsan (“South Quay Square Project”).

SCSB, had on 4 April 2023, signed a second supplemental agreement (“2nd Supplemental Agreement”) agreeing to include the additional scope of works (“Additional Works”) into the Principal Agreement.

With the Additional Works, an additional contract sum of RM606,638,291.48 has been agreed by SCSB and SSQ, in addition to the earlier announced contract sum of RM755,716,963.26, making up the new revised contract sum for the South Quay Square Project to RM1,362,355,254.74. The Additional Works are expected to be completed within 31 months by 31 October 2025.

Additional Works for South Quay Square Project has commenced since April 2023.
