We wish to announce that Metroplex Holdings Sdn Bhd (“Plaintiff”) has on 4 May 2011 through their solicitors served a Writ of Summons dated 29 April 2011, a summons-in-chambers dated 29 April 2011 and an affidavit affirmed by Mok Pak Hong on 29 April 2011 on the solicitors acting for OSK Trustees Berhad (as trustee for Sunway Real Estate Investment Trust) (“Trustee”) and Sunway REIT Management Sdn Bhd (“Manager”) in respect of a letter written to the Plaintiff on 28 April 2011 that the Trustee is the registered owner of Putra Place.
The Plaintiff is seeking the following orders from the High Court of Malaya in Kuala Lumpur ("High Court"):-

1. a declaration that the Trustee and the Manager are not owners of Putra Place; and

2. a declaration that the owner of Putra Place is as stated in the Form 16F and/or in the alternative as printed on the computer search-verification document-Form A as certified by Anisah bt Fauzi issued by the Land and Mines Office Kuala Lumpur, Federal Territory of KL.

If the above declarations are granted by the High Court, the Plaintiff seeks the following orders:-

(a) an order that the Trustee and the Manager and their directors and/or personnel and/or auxiliary police sent by the Trustee and the Manager be prohibited from coming within a distance of 250 metres from Putra Place until the disposal of the case;

(b) order the Trustee and the Manager to withdraw all letters written to the occupiers of Putra Place and to file an affidavit with the High Court to withdraw the said letters;

(c) the High Court to assess damages relating to the actions taken by the Trustee and the Manager as stated in the letter issued by the Trustees’ and the Manager’s solicitors, Messrs David Lingam dated 28 April 2011;

(d) any orders and relief which the High Court thinks fit; and

(e) costs.

In the summons-in-chambers dated 29 April 2011 which is fixed for hearing on 6 May 2011, the Plaintiff is seeking the following from the High Court pending the disposal of the relief sought in the abovementioned writ of summons:-

1. orders that the Trustee and the Manager as well as their directors and/or their personnel and/or auxiliary police sent by the Trustee and the Manager be prohibited from coming within a distance of 250 metres from Putra Place until the disposal of the case;

2. order the Trustee and the Manager to withdraw all letters written to the occupiers of Putra Place and to file an affidavit with the High Court to withdraw the said letters;

3. the High Court to assess damages relating to the actions taken by the Trustee and the Manager as stated in the letter issued by the Trustees’ and the Manager’s solicitors, Messrs David Lingam dated 28 April 2011;

4. any orders and relief which the High Court thinks fit; and

5. costs.

The Trustee and the Manager have been advised by their respective solicitors that in their opinion, the Plaintiff is not likely to succeed in its claims in the Writ of Summons against them.
