We wish to announce that OSK Trustees Berhad as trustee for Sunway Real Estate Investment Trust (“First Plaintiff”) and Sunway REIT Management Sdn Bhd (“Second Plaintiff”) (collectively the “Plaintiffs”) through their solicitors had on 27 May 2011, filed an originating summons and an affidavit-in-support affirmed by Ms Woo Lai Mei on behalf of the Plaintiffs in the High Court of Malaya in Kuala Lumpur and served a copy of these documents on the solicitors acting for Metroplex Holdings Sdn Bhd (“Defendant”) on 1 June 2011.
The Plaintiffs are seeking for certain declarations and orders including the following:-

1. a declaration that the First Plaintiff is the legal owner of the property held under Geran No. 10012 Lot No 38, Section 51, Mukim and Daerah Kuala Lumpur, Negeri Wilayah Persekutuan known as Putra Place (“Property”) since 19 April 2011;

2. an order that the Defendant, its servants or agents or otherwise deliver up, within 24 hours from the date of the court order, possession of each and every part of the Property that the Defendant, its related corporations, its servants or agents or otherwise in possession, occupation or control including but not limited to the common areas and the following:
      (a) Basement 1 and 2, including management office, maintenance office, store room, mechanical and electrical rooms and common/circulation areas;

      (b) security rooms (fire control rooms), service yards, mechanical and electrical rooms, store rooms, office room, and common/circulation areas, cleaner stores, toilets, car parking bays at Lower Ground Floor, Ground Floor and 1st to 8th Floors;

      (c) levels 9 to 35 comprising hotel/service apartments/penthouse;
3. a permanent injunction to be granted to restrain the Defendant, its servants or agents or otherwise howsoever from holding themselves out as the owner of the Property and from controlling and managing the Property or remaining on or entering the Property;

4. an order that in the event that the Defendant, its servant, agents or otherwise fails to hand over control and management of the Property or fail to deliver up possession as ordered by the Court and all other parts of the Property that the Defendant, its related corporations, its servants, agents or otherwise are in possession, occupation or control of within the time period ordered, the Second Plaintiff and the Court Bailiff be authorized to enforce and execute the Court Order and if necessary break open any outer or inner door or window of any part or the Property or any receptacle therein, using such force as is reasonably necessary and the Police be directed to provide all necessary assistance to the Second Plaintiff and the Court Bailiff in enforcing and executing the Court Order.

The High Court has fixed 3 June 2011 as a mention date for the parties to obtain further directions from the High Court in respect of the originating summons.
